Bridget Green Granted Compassionate Release
Universal Post Conviction celebrates the release of Bridgette Green.
Green suffered from several diseases that would have caused her to be at high risk for serious illness or death if she were to become infected with COVID-19. While in the Bureau of Prisons her condition worsened. She was near the end of her 24-sentence for fraud charges and serving her time at a women’s medical facility.
Universal Post Conviction met with her and filed her motion. The court ordered the government to respond and ordered us to submit a release plan for the claimant. The government, noting that Green was being considered for home confinement under the CARES Act and noting that she was not a danger to the community, agreed that she was an appropriate candidate for compassionate release.
The court granted the compassionate release after a 14 day quarantine and ordered that the remaining time on her sentence be added to hear term of supervised release.
Devonte Dillard Sentence Reduced By Half
Devonte Dillard is in Federal Prison with a Firearm and Robbery conviction. Dillard hired Universal Post Conviction to investigate his case and find out what could be done for him. After communicating with the client and his family members, the Office filed a 2255 motion explaining that Dillard's previous attorney was ineffective in that they failed to notify the client about the right to appeal the Court's ruling.
The Court wrote a response to the 2255 Motion To Vacate. The court scheduled the matter for a evidentiary hearing. At the evidentiary hearing, Dillard's former lawyer explained that while she let Dillard's mother know about the way to appeal, former counsel did not explain the right to appeal to Dillard himself. Further, during the hearing, the attorney explained that there would have been possible meritorious grounds while on appeal based on recent caselaw at the time. Ultimately, the court agreed that Dillard's former counsel was ineffective and allowed Dillard the right to file an appeal.
Ultimately, the Judge reduced Dillard's sentence from 20 years down to 10 years.
Bobby Countryman Receives Compassionate Release
Bobby Countryman was serving a sentence of 25 years for drug charges. He was sentenced in 2001 and was serving his sentence at Butner Medical Center in North Carolina. Countryman's sentence was originally scheduled to end in 2022. In 2020 as Corona Virus ravaged the country, Butner Medical Center was hit particularly hard. The Department of Justice's own internal inspectors determined that Butner was not acting incompliance with BoP protocols around the virus. Universal Post Conviction filed for Compassionate Release on Countryman's behalf, arguing that his age and preexisting conditions put him at particular risk for serious illness and death. The Office also indicated that Countryman was not a danger to others and was otherwise eligible for release. This was quickly followed by an order granting an immediate release from the court. Universal Post Conviction reached out to the Bureau of Prisons and asked for Countryman's immediate release pursuant to the Court's order. The Prison complied and Countryman was home within a few days.
